Questions & Answers

What is Regulation (EU) 2019/1020?

This regulation aims to strengthen market surveillance and compliance requirements for products circulating within the EU. According to Article 4, for certain products sold into the EU (including via e-commerce), if the manufacturer is not established in the Union, an EU-based economic operator (like an authorised representative or importer) must be designated. Their contact information must be on the product or packaging for traceability and to facilitate requests for technical documentation from authorities, ensuring product safety.

Why is it important for Taiwanese companies?

Taiwanese companies exporting products to the EU, especially those requiring CE marking, must comply with this regulation, whether through traditional trade or e-commerce platforms. Failure to designate an EU-based economic operator will result in products being blocked from entering the EU market by customs. Furthermore, authorities have the power to request technical files, order recalls, and impose penalties, causing both reputational and financial damage.

Which ISO standards or international regulations are directly related?

This regulation is highly relevant to ISO 9001 (Quality Management Systems), which ensures consistent product compliance. As part of the EU's New Legislative Framework (NLF), it is closely linked to the market enforcement of numerous CE marking directives (e.g., Low Voltage Directive 2014/35/EU, Machinery Directive 2006/42/EC). For future connected products, this regulation will also serve as the market surveillance enforcement basis for the Cyber Resilience Act (CRA).
